LAWS, The Robots are coming!

Lethal autonomous weapon systems (LAWS) are a special class of weapon systems that use sensor suites and computer algorithms to independently identify a target and employ an onboard weapon system to engage and destroy the target without manual human control of the system. Although these systems are not yet in widespread development, it is believed they would enable military operations in communications-degraded or -denied environments in which traditional systems may not be able to operate.

Contrary to a number of news reports, U.S. policy does not prohibit the development or employment of LAWS. Although the United States is not known to currently have LAWS in its inventory, some senior military and defense leaders have stated that the United States may be compelled to develop LAWS if U.S. competitors choose to do so. At the same time, a growing number of states and nongovernmental organizations are appealing to the international community for regulation of or a ban on LAWS due to ethical concerns.

Developments in both autonomous weapons technology and international discussions of LAWS could hold implications for congressional oversight, defense investments, military concepts of operations, treaty-making, and the future of war.

Do LAWS exist?

States are increasingly developing and deploying weapons with autonomous functions. However, certain systems incorporating rudimentary autonomous functions have been in existence for decades.

The most common types of weapons with autonomous functions are defensive systems. This includes systems such as antivehicle and antipersonnel mines, which, once activated, operate autonomously based on trigger mechanisms.

Newer systems employing increasingly sophisticated technology include missile defense systems and sentry systems, which can autonomously detect and engage targets and issue warnings. Other examples include loitering munition (also known as suicide, kamikaze or exploding drone) which contain a built-in warhead (munition) and wait (loiter) around a predefined area until a target is located by an operator on the ground or by automated sensors onboard and then attacks the target. These systems first emerged in the 1980s; however, their systems functionalities have since become increasingly sophisticated, allowing for, among other things, longer ranges, heavier payloads and the potential incorporation of artificial intelligence (AI) technologies.

Land and sea vehicles with autonomous capabilities are also increasingly being developed. Those systems are primarily designed for reconnaissance and information gathering but may possess offensive capabilities.
